1. All rights are reserved as to the changes of the terms and agreements as stated in the TOS at any one time. Your continued use of Soccerchemist.com will constitute your acceptance to the rights that we reserved.
2. You understand and agree that Soccerchemist.com assumes no responsibility for the timeliness, deletion, mis-delivery or failure to store any user communications or personalization settings.
3. You understand that through your use of Soccerchemist.com you consent to the collection and use of the registration and personal data and certain other information about you, including the transfer of this information to the United States and/or other countries for storage, processing and use by Soccerchemist.com.
4. You are responsible for maintaining the confidentiality of the password and account and are fully responsible for all activities that occur under your password or account, including all content whether publicly posted or privately transmitted, are your sole responsibility. By this, you agree to hold us harmless against any indemnity. Under no circumstances will Soccerchemist.com be liable in any way for any content.
5. You agree to not use Soccerchemist.com to carry out or make available any content that is unlawful, political, religious, harmful, threatening or otherwise objectionable(which includes impersonation, infringements of any patent, trademark, trade secret, copyright or other proprietary rights of any party, doing any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation, make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment).
6. You acknowledge that Soccerchemist.com shall have the right in her sole discretion to pre-screen, refuse, move or remove any content that violates the TOS or is otherwise objectionable.
7. You acknowledge, consent and agree that Soccerchemist.com may access, preserve and disclose your account information and content if required to do so by law or in a good faith belief that such access preservation or disclosure is reasonably necessary to:
(i) comply with legal process;
(ii) enforce the TOS;
(iii) respond to claims that any content violates the rights of third parties;
(iv) respond to your requests for customer service; or
(v) protect the rights, property or personal safety of Soccerchemist.com, its users and the public.
8. Any unauthorized reproduction, publication, further distribution or public exhibition of the materials provided on Soccerchemist.com, in whole or in part, is strictly prohibited.
9. You agree not to transfer, reproduce, duplicate, copy, sell, trade, resell or exploit for any commercial or non-commercial purposes, any portion of the service by Soccerchemist.com (including your Soccerchemist.com ID).
10. Soccerchemist.com reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, your account or membership with or without notice. You agree that Soccerchemist.com shall not be liable to you or to any third party for any modification, suspension or discontinuance of your account or membership.
11. You acknowledge and agree that Soccerchemist.com is not responsible or liable for any content, advertising, products, services or other materials on or available from any third-party sites or resources.
12. Disclaimer of warranties. You expressly understand and agree that:
a. Your use of the service is at your sole risk. Soccerchemist.com expressly disclaim all warranties of any kind.
b. Soccerchemist.com makes no warranty that
(i) Soccerchemist.com will meet your requirements;
(ii) Soccerchemist.com will be uninterrupted, timely, secure or error-free;
(iii) the results that may be obtained from Soccerchemist.com will be accurate or reliable; and
(iv) the quality of any products, services, information or other material purchased or obtained by you through Soccerchemist.com will meet your expectations.
c. Any material downloaded or otherwise obtained through Soccerchemist.com is accessed at your own discretion and risk, and you will be solely responsible for any damage to your computer system or loss of data that results from the download of any such material.
d. No advice or information, whether oral or written, obtained by you from Soccerchemist.com shall create any warranty not expressly stated in the tos.
13. You expressly understand and agree that Soccerchemist.com shall not be liable to you for any direct, indirect, incidental, special, consequential or exemplary damages, including, but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses.
